Terms of Service

Welcome to Aquix. These Terms of Service ("Terms") govern your access to and use of Aquix Baseball Insights — including our website at aquix.app and our iOS and Android mobile apps (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
Aquix is operated by Aquix LLC, based in the State of Utah, United States. In these Terms, "we," "us," and "Aquix" refer to Aquix LLC. "You" refers to the individual using the Service or the team or organization the individual represents.
1. The Service
Aquix is a baseball-coaching tool. It uses player statistics and drill results that you provide to generate AI-assisted lineup recommendations, pitching analytics, and player insights. The Service is intended to support — not replace — coaching judgment. All decisions about lineup construction, pitching changes, player evaluation, and any other coaching matter remain your responsibility.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with a parent or guardian's consent. If you create or manage an account for a youth-sports team, you represent that you are authorized to do so under any applicable league or organizational rules.
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information to Aquix, contact us at support@aquix.app and we will delete it.
3. Accounts and Sign-In
To use most of the Service you must create an account. You can sign in using Google, Apple, or an emailed magic link. By signing in with a third-party provider, you also accept that provider's terms.
You are responsible for:
- The accuracy of information you provide
- Keeping your sign-in credentials secure
- All activity that occurs under your account
- Notifying us promptly at support@aquix.app if you suspect unauthorized account use
4. Free Trial
New accounts receive a 7-day free trial of the full Service. The trial begins when you first sign up. No payment is required during the trial. At the end of the 7 days, your access ends unless you subscribe.
5. Subscriptions, Billing, and Auto-Renewal
After the free trial, the Service is available on a paid subscription basis. Current pricing:
- Monthly: $4.99 USD per month
- Annual: $49.99 USD per year
Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price for that period until you cancel. Your payment method on file will be charged at the start of each renewal period.
How to cancel. You can cancel anytime through the platform where you originally subscribed:
- Subscribed on the web: manage your subscription from your account settings within Aquix, or directly in your Stripe billing portal.
- Subscribed via Apple App Store (iOS): Settings → [your Apple ID] → Subscriptions.
- Subscribed via Google Play (Android): Play Store → profile icon → Payments and subscriptions → Subscriptions.
Cancellation takes effect at the end of the current billing period; you retain access until then. You will not be charged for periods that begin after cancellation.
Price changes. We may change prices for new or future renewal periods. If we change the price of your subscription, we will notify you in advance through the app or by email, and the new price will take effect on your next renewal. If you don't want to renew at the new price, you can cancel before that date.
Cross-platform access. When you subscribe, your subscription grants access to the Service on every platform you sign in to with the same account — web, iOS, and Android. Paying on one platform does not require separate payment on another.
6. Refunds
Refund handling depends on the platform you subscribed through:
- Stripe (web subscriptions): contact support@aquix.app within 7 days of an unwanted charge and we will review your request.
- Apple App Store: refunds are handled by Apple. Visit reportaproblem.apple.com.
- Google Play: refunds are handled by Google. Visit your Play Store order history.
Aquix does not separately issue refunds for purchases made through Apple or Google; those platforms have their own refund policies and processes.
7. Your Content
You retain ownership of the content you upload to the Service — including team rosters, player statistics, drill results, lineups, and any notes or tags you add ("Your Content"). You grant Aquix a limited, non-exclusive, royalty-free license to store, process, and display Your Content for the sole purpose of providing the Service to you and your team.
You represent that you have all rights necessary to upload Your Content and that doing so does not violate the rights of any third party (including any league, organization, parent, or player whose data may be involved).
You can delete Your Content from the Service at any time through the app. When you delete content, we remove it from active systems promptly; backup copies may persist for a limited period in our normal backup rotation.
8. Acceptable Use
You agree not to:
- Use the Service in any way that violates applicable law or the rules of any league or organization you participate in
- Upload content you don't have the right to upload
- Attempt to access another user's account or data without authorization
- Reverse-engineer, decompile, or attempt to extract the source code of the Service (except where applicable law expressly permits this)
- Probe, scan, or test the vulnerability of the Service or its infrastructure
- Use the Service to send spam, harass others, or distribute malware
- Interfere with the Service's operation or other users' use of it
- Use automated systems (bots, scrapers, etc.) to access the Service without our written permission
- Misrepresent your identity or affiliation
We may suspend or terminate accounts that violate these Terms, at our discretion.
9. Intellectual Property
The Service — including its software, design, branding, AI models, lineup-grading algorithms, drill-scoring formulas, and verdict copy — is the property of Aquix LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or team coaching use. They do not transfer any ownership of the Service to you. You may not copy, modify, distribute, sell, or create derivative works based on the Service or any part of it.
10. Third-Party Services
The Service integrates with third-party platforms to provide certain features:
- Firebase (Google) — authentication, database, and notifications
- Stripe — web subscription billing
- Apple App Store / Google Play — mobile subscription billing
- RevenueCat — cross-platform subscription management
- Netlify — web hosting
- Capacitor (Ionic) — mobile app framework
Your use of these third-party services is subject to their own terms and privacy policies. Aquix is not responsible for the practices of third-party providers, although we make commercially reasonable efforts to work only with providers that take security and privacy seriously.
11. Privacy
Your privacy matters. Our Privacy Policy explains what we collect, how we use it, and your choices. By using the Service, you agree to the practices described in the Privacy Policy.
12. Termination
You may stop using the Service at any time. To fully close your account, use the "Delete Account" option inside the app's Settings.
We may suspend or terminate your access to the Service if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Where reasonably possible we will give notice before doing so. Sections of these Terms that by their nature should survive termination (including IP, disclaimers, limitation of liability, and dispute resolution) will survive.
13. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any defects will be corrected.
AI-generated content is advisory only. Lineup recommendations, pitching role assignments, player ratings, verdict text, and any other AI-generated output are provided to support your coaching judgment. Aquix is not responsible for the outcome of any decision you make using the Service. Baseball is a game of chance and human factors that no analytics tool can fully account for.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Aquix LLC, its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Service — including loss of profits, loss of data, loss of goodwill, or other intangible losses — even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to the Service or these Terms is limited to the greater of (a) the amount you paid Aquix for the Service in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Aquix LLC from any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) Your Content, or (c) your violation of any law or the rights of any third party.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction in those courts.
The U.N. Convention on Contracts for the International Sale of Goods does not apply to these Terms.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. For material changes, we will provide additional notice through the app or by email. If you continue to use the Service after the new Terms take effect, you accept the updated Terms. If you don't accept the changes, your remedy is to stop using the Service and cancel any active subscription.
18. Miscellaneous
Entire agreement. These Terms (together with the Privacy Policy and any platform-specific terms you accept) constitute the entire agreement between you and Aquix LLC regarding the Service.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full effect.
No waiver. Our failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely (for example, in connection with a sale or merger of the business).
